Inheritance Law Principles as Defining Principles for Further Updating of Inheritance Legislation of Ukraine

The article is focused on establishing the range of inheritance law principles, which are characterized by universality, since theyare implemented in all institutions this sub-branch. It has been noted that field as a sub-branch civil isbased certain basic ideas (principles) cover both relevant legislation and functioning entire system ofinheritance legal succession express specifics law. Therefore, definition such principles clari -fication their essence will contribute to further development doctrine, unity practice implementing inheritancelegislation, its improvement.The not directly reproduced norms legislation, but follow from contentand fundamental nature, expressing most important regularities area. Based analysis doctrineand author revealed following principles: principle universal inheri -tance succession, freedom last testament, social justice. emphasized thatthe justice identical general (the Art. 3 ofthe Civil Code Ukraine).It substantiated should be distinguished normative provisions regulating certaintype relations (priority calling for lawful heirs; equality shareswithin hereditary succession; recognition rights household items appropriate heirs within succession),however, they accordance with functional purpose.
